Spinning Out of Control

As a pilot, I can tell you that a spin is something to be avoided. It can be hard to recover from, and loss of control will result in a crash. Team Kimberlin and its fanboys and enablers seem to be spinning out of control in their reaction to the peace order extension issued last Monday against Bill Schmalfeldt.

The order simply requires Schmalfeldt to refrain from contacting, attempting to contact, or harassing me.

Most of the brouhaha is Team Kimberlin’s misrepresentation of Judge Stansfield’s findings with respect to Twitter and what constitutes contact under the terms of Maryland’s harassment statutes and the peace order he issued.

Notice that I wrote statutes. Plural. Maryland has two laws that are applicable. The first is the general harassment statute which deals with any intentional course of conduct that seriously annoys, alarms, or harasses the victim and that continues after the perpetrator…

Dan Backer, Aaron Walker’s attorney, as filed a Response to Defendant Kimberlin’s Motion to Dismiss in advance of next Tuesday’s hearing in the Virginia Walker v. Kimberlin, et al. lawsuit. He seems to do a reasonable job of demolishing both the form and the substance (such as there is) of TDPK’s argument.

Exhibit A may be particularly useful to the Gentle Reader who is wondering how it is that a Virginia court goes about applying the laws of another state or federal law to a tort case tried in the Commonwealth.

Meanwhile, I’m working to clear my schedule so that I can be in Manassas for the hearing next week. I look forward to the process of bringing Team Kimberlin to justice taking another step ahead.

Let me provide some background for those Gentle Readers who have not been following the Saga of The Dread Pirate Kimberlin for as many months as I have. The current series of episodes began with a lawsuit TDPK filed against a blogger named Seth Allen. I won’t go through all the details, but because of a series of technical mistakes Mr. Allen made, TDPK Kimberlin secured a default judgment against him. TDPK sought an injunction against Mr. Allen requiring him to stop blogging about TDPK and a total of $2,250,000 in monetary damages. At the damages hearing in November, 2011, the judge issued an injunction requiring that Mr. Allen not defame TDPK but that allowed him to continue with non-defamatory blogging. He also awarded $100 in “nominal damages.”

When you look at the 2012 election map you see there was a clear winner as most of the country went red.  Just from looking at it, the map shows Romney won handily as nearly 90%, if not more than 90% of the nation went red.  Then why are we not saying President Romney?  Some say it’s voter fraud, and there may be some validity behind that.  But is that the only reason?  I say NO!  Is that the main reason?  I say NO!  You see I’ve looked at this and find that the Liberals very intelligently thought out, calculated, and then played the numbers to their advantage in a pure brilliant way.  The way they truly won was not voter fraud, but instead by population manipulation.

Last night, we retained the majority in the House of Representatives. I can see some positives in that situation.

While the Speaker has in recent days predicted a victory for Republican nominee Mitt Romney, he made no such declaration shortly before 10 p.m. on Tuesday, after the House was projected to stay in GOP hands.

“I want to thank Mitt Romney and Paul Ryan, who have carried the banner of our party with grace, vision, strength and dignity,” Boehner said to cheers from the crowd.

Insanity, so the saying goes, is continuing to do the same thing over and over again expecting a different result. Nominating and even electing RINO politicians as not been a successful means of turning the country from the path of Progressivism that we started down in the 20th century.

Before it was co-opted by secularists, American Progressivism had religious roots. There was a stream of eschatological thinking among some Christians called Postmillennialism which tied the return of Christ to a golden age to come when the Church had converted more or less everyone and the world had been cleaned up enough for the Second Coming. Prohibition was one part of the tidying up. Politicians such as Teddy Roosevelt saw themselves as doing the Lord’s work.
